This website (the “Site”) is owned by Adaptive Roots Consulting LLC (“Adaptive Roots”, “we”, “us”), and this Privacy Policy (this “Policy”) is to inform you of our collection, use, and disclosure practices regarding information that we collect through the Site. Our goal at Adaptive Roots is to maintain the trust and confidence of our users. This Policy applies only to information gathered on and through this Site, and does not apply to any other information, content (including advertising), link, or website not operated by Adaptive Roots. To the extent our Site refers you to a third-party site, such sites operate independently from our Site and may have their own privacy policies or terms of use.  We are not responsible for the content of these sites, any products or services that may be offered through these sites, or any other use of these sites, and we strongly encourage you to review carefully the privacy policies and other terms and conditions of these third-party sites upon visiting them.

Please review this Policy periodically as we may update it from time to time. Each time you visit or provide us with information, you are, by doing so, accepting the practices described in this Policy at that time. You agree that by using the Site you are expressly and affirmatively consenting to our use and disclosure of the information you provide in accordance with the Policy.

1.      Policy Applicability

This Policy applies to information we collect, process, or transfer:

  • On this Site

  • In email, text, and other communications between you and Adaptive Roots.

  • Offline or through any other means, including interaction with one of our employees or any third party on behalf of Adaptive Roots.

  • During the ordering, payment, and shipping process through or facilitated through this Site.

 

2.      Collection of Personal Information

We collect two types of information, personally identifiable information and non-personally identifiable information. Personally identifiable information includes any information that is linked or reasonably linkable to you. The sources of information we collect, process, or transfer on or through our Site or within Adaptive Roots may include:

  • Information that you provide submitting messages, reviews, scheduling consultations, or other communications to us or third parties on our Site (“User Contributions”). This includes information provided at the time of purchasing or considering our services, giving feedback, when entering a promotion or contest sponsored by us, or when you report a problem with our Site. (See Section 2a below). Please be aware your User Contributions are posed on and transmitted to others at your own risk. Additionally, we cannot and do not guarantee that your User Contributions will not be viewed by other users or third party persons.

  • Records and copies of your correspondence (including e-mail addresses), if you contact us.

  • Your responses to surveys that we might ask you to complete for research purposes.

  • Transaction details that you carry out through our Site and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Site.

  • Your interactions with our Site through automatic data collection (described below).

  • Information received about you from the other third party or affiliate sources such as updated delivery and address information from carriers to ease the delivery process.

a.      Information You Voluntarily Submit to Us

Certain information that we collect comes directly from you when you voluntarily submit it to us as a potential client or client. This includes information you may email us, provide over the phone, or send us through the “Let’s Connect” or “Sign up to receive news and updates” links on our Site. It may also include information you provide when you sign up for an online course or request to receive news and updates.  Such information may include:

  • Contact Information such as name, address, date of birth, telephone number, or email address;

  • Information about your transactions with us or others, including debit card information, credit card number and information, and/or other payment information; or

  • Education, work affiliation, career, professional aspirations, and other job related information

 b.     Automatic Data Collection

Our Site uses automatic data collection technologies to collect certain information about your interaction with our services, Site content, your operating system, your device, browsing actions, patterns (i.e., traffic and location data), and your Internet Protocol address. Other example of information we may collect includes:

  • Devices metrics such as when a device is in use, application usage, connectivity data, and any errors or event failures;

  • IP address, location data, usage data (e.g., page views), browser type;

  • Time Zone Settings; and

  • Full Uniform Resource Locator (“URL”) clickstream to, through, and from our Site including services and content searched for and viewed, page response times, length of visits on webpages, and page interaction information such as scrolling and clicking.

The information we collect automatically does not include personal information, but we may maintain it or associate it with personal information we collect in other ways. We do this because it helps us to improve our Site and deliver better and more personalized experience and services, including by enabling us to enhance search time and fix user interface issues quicker, among other benefits.  Information may also be collected automatically by third-party service providers (e.g., payment processors, email and content distribution providers, etc.) on our behalf, who are contractually obligated to maintain the security and confidentiality of personal information.

The technologies we or our third-party service providers use for this automatic data collection may include, but are not limited to:

  • Cookies (or browser cookies). A cookie is a small file place on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Site.

  • Web Beacons. Pages of our Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Adaptive Roots, for example, to count users who have visited its webpages and for other related website statistics (for example, recording the popularity of certain Site content and verifying system and server security).

  • Flash Cookies. Certain features of our Site may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Site. Flash cookies are not managed by the same browser settings as are used for browser cookies.

We or our third-party service providers use cookies, web beacons, device identifiers, and other technologies to recognize your browser or device, learn more about your interests and provide you with essential features and/or services, and for purposes, including:

  • Preventing fraudulent activity.

  • Improving our Site’s and your personal information security.

  • Tailoring our services to your interest.

  • Tracking your specified preferences such as whether you want to see internet-based ads.

  • Conducting diagnostics and research to improve the performance of our Site’s services and other content.

  • Knowing the items in your cart when checking out.

  • Measuring and analyzing the performance of our services.

 

3.      Use of Personal Information

We use information that we collect about you or that you provide to us, including any personal information in the following ways:

  • To present our Site, services and/or related contents to you.

  • To provide you with information and/ or services that you request from us.

 We may also use your information to contact you about our own or third parties' products/services that may be of interest to you. If you do not want us to use your information in this way, please opt out of this feature by contacting our data privacy department.

We may disclose aggregated, unidentifiable information about you without restriction. We may disclose personal information that we collect or you provide as described:

  • To service providers, contractors, and other third parties used to support our business.

  • To third parties to market their products and/or services to you if you have consented to/not opted out of these disclosures.

  • To third parties to enforce our obligations or rights under our terms of use policy and/or terms of sale, including billing and collection purposes.

  • To a successor in the event of a merger, sale of substantially all our assets (which includes personal information), divestiture, restructuring, reorganization, or dissolution.

  • To accomplish the purpose for which you request. For example, if you give us an email address to use the "email a friend" feature of our Website, we will transmit the contents of that email and your name to the recipients.

  • To comply with any government agency or court order, subpoena, or legal requirements.

  • If we determine disclosure is necessary or appropriate to protect the rights, property, or safety of our business, our customers, or the public. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

5.      Retention of Personal Information

We will retain your personal information as long as it is needed for our business purposes and in accordance with applicable law. In determining this, we will be considerate of the amount, nature, and sensitivity of the personal information, the potential risk of harm to the personal information, and whether our purposes can be achieved through other means.

 

6.      Sale of Personal Information

We do not currently sell your personal information to any third parties for their own direct marketing purposes or for any monetary consideration. Should this change, we will update the privacy policy and our mechanisms to comply with any opt-in/opt-out requirements under applicable law.

 

7.      Consumer Rights Regarding Personal Information

We endeavor to give you the right to choose regarding the personal information you provide to us. Therefore, we have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. Our Site is not designed to respond to “do not track” request from browsers. You can set your browser to refuse all or some cookies. If you decline cookies, then please note that some parts of our Site may not functional properly.

  • Promotional Offers and Advertisement from Adaptive Roots. If you do not wish to have your personal information used by Adaptive Roots to promote and/or advertise our own services, you can opt-out by contacting our data privacy department.

8.      Security of Personal Information

We have implemented security measures to protect your personal information from unauthorized access, data breaches, and accidental loss. However, we still urge you to be careful about giving out information in public areas of the Site like reviews, testimonies, or other publicly facing User Contributions. A user of the Site may view the information you share in public areas of our Site.

Unfortunately, the transmission of information via internet is not completely secure. Even though we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any of our Site’s privacy settings or security measures.

For changes to this Policy, we will update the privacy policy posted on this Site, and may accompany the changes with an email to users who have provided their email addresses. You are responsible for ensuring we have an up-to-date active and deliverable email address for you.
